US E-bike Battery Compliance: DOT, UL, and the State-Law Patchwork

There is no single US “approval” you can put on an e-bike battery and call it done. Selling into the US means mapping a patchwork: a federal transport baseline that applies everywhere, a federal safety rule that is still only proposed, and binding state and city gates that are already here. Getting US e-bike battery compliance right is about knowing which of these is in force today, which is coming, and which UL standard to put in your RFQ.

The federal transport baseline (in force)

Before any market rule, there is shipping. In the US, lithium batteries are regulated as a hazardous material under the DOT Hazardous Materials Regulations (HMR), 49 CFR Parts 171–180 — Class 9 dangerous goods, applicable regardless of which state the pack ends up in. The proposed federal safety rule (not law yet)

This is where importers get confused. On 30 April 2025, the CPSC voted 3-2 to advance a Notice of Proposed Rulemaking (NPR) for a safety standard covering e-mobility devices and their lithium-ion batteries. The key word is proposed. It is in rulemaking — out for public comment, not a binding federal mandate you must meet today. Treat it as a strong signal of where federal policy is heading, track the docket, but do not assume there is already a nationwide UL requirement at the federal level. There is not.

The binding gates are state and city

Because there is no single federal product-safety mandate yet, the requirements that actually gate the US market are emerging state by state and city by city.

New York City’s Local Law 39 (2023) already requires e-bikes and micromobility devices sold, leased, or distributed in the city to meet UL safety standards. California’s SB 1271 requires all new e-bike batteries sold in the state to meet the battery standard referenced by UL 2849 or EN 15194, or be tested as part of a complete electrical system to UL 2849 or EN 15194, starting 1 January 2026. These two are the leading examples, not the complete list, and the landscape is moving fast. Treat this as a map, not legal advice: confirm the current requirements for each target state with qualified counsel before you sell.

UL 2271 vs UL 2849 — what to spec

Across these gates, the credential that matters is UL — and there are two:

  • UL 2271 certifies the battery pack itself.
  • UL 2849 certifies the complete e-bike electrical system (battery, charger, drivetrain), and UL 2849 requires the battery to be certified to UL 2271.

So the answer depends on what you sell: if you supply packs, UL 2271 is your baseline; if you place complete e-bikes on the market, plan for UL 2849 at the system level, which pulls UL 2271 in with it. What to demand from your manufacturer

US compliance resolves to having the right UL certification in hand for the states you sell into:

  • The right UL standard for what you place on the marketUL 2271 for the battery pack, UL 2849 for a complete e-bike electrical system (which requires UL 2271). California SB 1271 uses the referenced battery-standard / complete-system framing above; NYC Local Law 39 requires UL-certified product.
  • Verifiable test reports and certificate numbers, matched to the exact pack you are buying — not a logo on a brochure.

A manufacturer that already ships UL-certified packs into NYC and California has done this before and can produce the certificates; one that cannot is a risk to your US launch date.

FAQ

Is there a federal law requiring UL certification for e-bike batteries? Not yet. The CPSC has advanced a proposed rule (an NPR, April 2025) but it is not final. The binding requirements today are at the state and city level — for example NYC Local Law 39 and California SB 1271.

UL 2271 or UL 2849 — which do I need? UL 2271 certifies the battery pack; UL 2849 certifies the full e-bike electrical system and requires the battery to meet UL 2271. Spec to what you place on the market: packs → 2271, complete systems → 2849 (which includes 2271).

When does California require UL certification? California SB 1271 applies from 1 January 2026. For e-bike batteries, the law points to the battery standard referenced by UL 2849 / EN 15194, or testing as part of a complete UL 2849 / EN 15194 electrical system.
